In the article, the author presented the issue of the legality of using drones as a means of waging war during war and military operations, emphasizing the scope of use of military drones, the fact of being a means of waging war. The author studied the issue of legality from two perspectives: the right to wage war and international humanitarian law. In the context of the right to wage war, the author addressed the right to self-defense, the regulation of the Charter of the United Nations, and the legality of the use of force underlying the right to wage war. In the context of international humanitarian law, he addressed four fundamental rules (principles): distinction, proportionality, warning, and military necessity, in the light of the 1949 Geneva Conventions, their Additional Protocols, and other legal norms. Within the framework of the principle of distinction, the author addressed the distinction between the civilian population and military subjects (combatants) and objects. Within the framework of the principle of proportionality, the author addressed the issue of balancing and making proportional the damage caused and the military advantage gained, emphasizing the fact of causing minimal damage. Within the framework of the principle of precaution, the author emphasized the fact of this principle as a preventive function. Within the framework of the principle of military necessity, the author addressed the important idea that this principle is designed to reduce the use of unnecessary military force.
